By downloading, installing, or using ViviTap ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and Muny Roth CHEV ("we", "us", "our"), the operator of ViviTap.
ViviTap is a supplementary communication assistance application that enables people with communication disabilities ("helpees") to communicate with caregivers and family members ("helpers") using pre-defined and customizable message buttons, voice output, and real-time audio/video calls.
ViviTap is a supplementary communication tool. It must NOT be used as a substitute for emergency services, a medical or therapeutic device, or the sole means of communication in life-threatening situations.
In an emergency, call your local emergency number (112 in Europe).
Users are advised to maintain alternative means of communication at all times.
We expressly disclaim all liability for harm arising from: failure to deliver messages due to device/OS restrictions, app unavailability, reliance on the App as a primary safety tool, or network issues beyond our control.
To the maximum extent permitted by applicable law, our total liability for indirect, incidental, or consequential damages shall not exceed the amount you paid us in the 12 months preceding the claim. Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law (including §§ 307, 309 BGB).
You must be at least 16 years old to create an account. If you are under 16, a parent or legal guardian must create and manage the account with their explicit consent.
To connect with another user, you must send a connection request. The recipient will see your username and may accept or decline. A connection is only established upon explicit acceptance. You may not send repeated connection requests to users who have declined your request.
You may upload images as profile photos or as icons for custom communication buttons, and you may add web links (URLs) to custom buttons. You are solely responsible for all content you upload and all links you add. You agree not to upload or link to content that is illegal, offensive, violent, sexually explicit, or harmful.
ViviTap is not responsible for the content of external websites accessed through links added to custom buttons. Users access such websites at their own risk.
You can report inappropriate content via Settings → Security → Report Content.
Current prices are shown in the app and on the Google Play Store at the time of purchase. Prices are set in EUR and converted to your local currency by Google Play; the exact amount charged may vary by country due to currency conversion and local taxes.
We may offer promotional access or foundation codes to selected individuals or organizations. Such offers may be withdrawn at any time.
Subscriptions are billed monthly through Google Play (Google LLC). Subscription management is handled by RevenueCat Inc. on our behalf.
You may cancel at any time through Google Play settings. No refunds for partial billing periods except as required by law.
EU consumers have a 14-day right of withdrawal. By confirming your subscription and requesting immediate access, you acknowledge that you lose your right of withdrawal once the service has commenced (Art. 16(m) Directive 2011/83/EU).
You agree not to: harass, harm, or abuse others; gain unauthorized access to accounts or systems; reverse engineer or modify the App; transmit unlawful or harmful content.
All content and functionality of ViviTap are the exclusive property of Muny Roth CHEV. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended communication assistance purposes.
We may suspend or terminate your account for violations of these Terms, with prior notice where reasonably possible. You may delete your account at any time via Settings → Security → Delete Account.
These Terms are governed by the laws of the Federal Republic of Germany. Disputes shall be subject to the jurisdiction of the courts of Stuttgart, Germany, unless mandatory consumer protection law of your country of residence provides otherwise.
If we make material changes, we will notify you within the App at least 30 days before the changes take effect. If you do not agree, you must stop using the App and may delete your account before the effective date.
En téléchargeant, installant ou utilisant ViviTap ("l'Application"), vous acceptez d'être lié par ces Conditions Générales d'Utilisation. Si vous n'acceptez pas, n'utilisez pas l'Application.
Ces CGU constituent un accord juridiquement contraignant entre vous et Muny Roth CHEV ("nous"), l'opérateur de ViviTap.
ViviTap est un outil de communication complémentaire permettant aux personnes ayant des difficultés de communication ("aidés") de communiquer avec leurs aidants et proches ("helpers") via des boutons de messages prédéfinis et personnalisables, une sortie vocale, et des appels audio/vidéo en temps réel.
ViviTap est un outil complémentaire. Il NE DOIT PAS être utilisé comme substitut aux services d'urgence, comme dispositif médical ou thérapeutique, ou comme unique moyen de communication en situation d'urgence.
En cas d'urgence, appelez le numéro d'urgence local (112 en Europe).
Les utilisateurs sont invités à maintenir des moyens de communication alternatifs à tout moment.
Nous déclinons toute responsabilité pour les dommages résultant de : l'échec de livraison des messages dû aux restrictions des appareils/OS, l'indisponibilité de l'application, l'utilisation de l'application comme outil de sécurité principal, ou des problèmes réseau hors de notre contrôle.
Dans les limites du droit applicable, notre responsabilité totale pour les dommages indirects ne dépassera pas le montant que vous nous avez payé au cours des 12 mois précédant la réclamation. Rien dans ces CGU ne limite notre responsabilité en cas de décès ou de dommage corporel causé par négligence, de fraude, ou pour toute responsabilité ne pouvant être exclue par la loi applicable (notamment §§ 307, 309 BGB).
Vous devez avoir au moins 16 ans pour créer un compte. Si vous avez moins de 16 ans, un parent ou tuteur légal doit créer et gérer le compte avec son consentement explicite.
Pour vous connecter à un autre utilisateur, vous devez envoyer une demande de connexion. Le destinataire verra votre identifiant et pourra accepter ou refuser. La connexion n'est établie qu'après acceptation explicite. Vous ne pouvez pas envoyer des demandes répétées à des utilisateurs qui ont refusé votre demande.
Vous pouvez télécharger des images comme photo de profil ou comme icônes de boutons de communication personnalisés, et ajouter des liens web (URLs) à des boutons personnalisés. Vous êtes seul responsable de tout le contenu téléchargé et de tous les liens ajoutés. Vous vous engagez à ne pas télécharger ni lier du contenu illégal, offensant, violent, sexuellement explicite ou nuisible.
ViviTap n'est pas responsable du contenu des sites web externes accessibles via les liens ajoutés aux boutons personnalisés. Les utilisateurs accèdent à ces sites à leurs propres risques.
Vous pouvez signaler un contenu inapproprié via Paramètres → Sécurité → Signaler un contenu.
Les prix actuels sont affichés dans l'application et sur le Google Play Store au moment de l'achat. Les prix sont fixés en EUR et convertis dans votre devise locale par Google Play ; le montant exact facturé peut varier selon le pays en raison de la conversion de devise et des taxes locales.
Nous pouvons offrir des accès promotionnels ou des codes de fondation à certaines personnes ou organisations. Ces offres peuvent être retirées à tout moment.
Les abonnements sont facturés mensuellement via Google Play (Google LLC). La gestion des abonnements est assurée par RevenueCat Inc. en notre nom.
Vous pouvez annuler à tout moment via les paramètres Google Play. Pas de remboursement pour les périodes partielles sauf obligation légale.
Les consommateurs UE disposent d'un droit de rétractation de 14 jours. En confirmant votre abonnement et en demandant un accès immédiat, vous reconnaissez perdre ce droit dès le début de la prestation (Art. 16(m) Directive 2011/83/UE).
Vous vous engagez à ne pas : harceler, nuire ou abuser d'autrui ; accéder de manière non autorisée à des comptes ou systèmes ; décompiler ou modifier l'Application ; transmettre du contenu illicite ou nuisible.
Tout le contenu et les fonctionnalités de ViviTap sont la propriété exclusive de Muny Roth CHEV. Vous bénéficiez d'une licence limitée, non exclusive et non transférable pour utiliser l'Application à ses fins d'aide à la communication.
Nous pouvons suspendre ou résilier votre compte en cas de violation de ces CGU, avec préavis dans la mesure du possible. Vous pouvez supprimer votre compte à tout moment via Paramètres → Sécurité → Supprimer le compte.
Ces CGU sont régies par le droit de la République Fédérale d'Allemagne. Les litiges relèvent de la compétence des tribunaux de Stuttgart, Allemagne, sauf disposition contraire du droit de la consommation applicable dans votre pays de résidence.
En cas de modifications substantielles, nous vous en informerons dans l'Application au moins 30 jours avant leur entrée en vigueur. Si vous n'acceptez pas les nouvelles CGU, vous devez cesser d'utiliser l'Application avant la date d'effet.
Durch das Herunterladen, Installieren oder Verwenden von ViviTap ("die App") stimmen Sie diesen Nutzungsbedingungen zu. Wenn Sie nicht zustimmen, verwenden Sie die App nicht.
Diese Bedingungen stellen einen rechtsverbindlichen Vertrag zwischen Ihnen und Muny Roth CHEV ("wir", "uns"), dem Betreiber von ViviTap, dar.
ViviTap ist eine ergänzende Kommunikationshilfe-App, die Menschen mit Kommunikationseinschränkungen ("Betreute") ermöglicht, mit Betreuern und Familienmitgliedern ("Helfer") über vordefinierte und anpassbare Nachrichten-Schaltflächen, Sprachausgabe und Echtzeit-Audio-/Videoanrufe zu kommunizieren.
ViviTap ist ein ergänzendes Kommunikationsmittel. Es darf NICHT als Ersatz für Notfalldienste, als medizinisches oder therapeutisches Gerät oder als einziges Kommunikationsmittel in lebensbedrohlichen Situationen verwendet werden.
Im Notfall rufen Sie die lokale Notrufnummer an (112 in Europa).
Nutzer werden empfohlen, jederzeit alternative Kommunikationsmittel verfügbar zu halten.
Wir schließen jede Haftung für Schäden aus, die entstehen durch: Nicht-Zustellung von Nachrichten aufgrund von Geräte-/OS-Einschränkungen, App-Nichtverfügbarkeit, Nutzung der App als primäres Sicherheitssystem oder Netzwerkprobleme außerhalb unserer Kontrolle.
Im gesetzlich zulässigen Umfang beschränkt sich unsere Haftung für mittelbare oder Folgeschäden auf den Betrag, den Sie uns in den 12 Monaten vor dem Anspruch gezahlt haben. Nichts in diesen Bedingungen schränkt unsere Haftung für Tod oder Körperverletzung durch Fahrlässigkeit, Betrug oder sonstige gesetzlich nicht ausschließbare Haftung ein (einschließlich §§ 307, 309 BGB).
Sie müssen mindestens 16 Jahre alt sein, um ein Konto zu erstellen. Wenn Sie unter 16 Jahre alt sind, muss ein Elternteil oder gesetzlicher Vormund das Konto mit ausdrücklicher Einwilligung erstellen und verwalten.

Eine Verbindung wird nur nach ausdrücklicher Annahme hergestellt. Sie dürfen keine wiederholten Anfragen an Nutzer senden, die Ihre Anfrage abgelehnt haben.
Sie können Bilder als Profilfoto oder als Symbole für benutzerdefinierte Kommunikationsschaltflächen hochladen und Weblinks (URLs) zu benutzerdefinierten Schaltflächen hinzufügen. Sie sind allein für alle hochgeladenen Inhalte und hinzugefügten Links verantwortlich. Sie verpflichten sich, keine illegalen, beleidigenden, gewalthaltigen, sexuell expliziten oder schädlichen Inhalte hochzuladen oder zu verlinken.
ViviTap ist nicht verantwortlich für den Inhalt externer Websites, auf die über Links in benutzerdefinierten Schaltflächen zugegriffen wird. Nutzer besuchen solche Websites auf eigenes Risiko.
Unangemessene Inhalte können über Einstellungen → Sicherheit → Inhalt melden gemeldet werden.
Die aktuellen Preise werden in der App und im Google Play Store zum Zeitpunkt des Kaufs angezeigt. Die Preise werden in EUR festgelegt und von Google Play in Ihre lokale Währung umgerechnet; der genaue Rechnungsbetrag kann je nach Land aufgrund von Währungsumrechnung und lokalen Steuern variieren.
Wir können nach eigenem Ermessen Aktionszugänge oder Stiftungscodes an ausgewählte Personen oder Organisationen anbieten. Solche Angebote können jederzeit widerrufen werden.
Abonnements werden monatlich über Google Play (Google LLC) abgerechnet. Die Abonnementverwaltung erfolgt durch RevenueCat Inc. in unserem Namen.
Sie können jederzeit über die Google Play-Einstellungen kündigen. Keine Rückerstattung für anteilige Abrechnungszeiträume, außer gesetzlich vorgeschrieben.
EU-Verbraucher haben ein 14-tägiges Widerrufsrecht. Durch Bestätigung Ihres Abonnements und die Anforderung des sofortigen Zugangs erkennen Sie an, dass Sie Ihr Widerrufsrecht mit Beginn der Leistungserbringung verlieren (Art. 16(m) Richtlinie 2011/83/EU).
Sie verpflichten sich, Folgendes zu unterlassen: andere zu belästigen, zu schädigen oder zu missbrauchen; unbefugten Zugang zu Konten oder Systemen zu erlangen; die App zu dekompilieren oder zu modifizieren; rechtswidrige oder schädliche Inhalte zu übermitteln.
Alle Inhalte und Funktionalitäten von ViviTap sind ausschließliches Eigentum von Muny Roth CHEV. Ihnen wird eine beschränkte, nicht ausschließliche, nicht übertragbare Lizenz zur Nutzung der App für ihre bestimmungsgemäßen Kommunikationszwecke gewährt.
Wir können Ihr Konto bei Verstößen gegen diese Bedingungen sperren oder kündigen, soweit möglich mit vorheriger Ankündigung. Sie können Ihr Konto jederzeit über Einstellungen → Sicherheit → Konto löschen löschen.
Diese Bedingungen unterliegen dem Recht der Bundesrepublik Deutschland. Streitigkeiten unterliegen der Gerichtsbarkeit der Gerichte in Stuttgart, Deutschland, sofern nicht zwingendes Verbraucherschutzrecht Ihres Wohnsitzlandes etwas anderes vorsieht.
Bei wesentlichen Änderungen werden wir Sie mindestens 30 Tage vor Inkrafttreten in der App benachrichtigen. Wenn Sie den aktualisierten Bedingungen nicht zustimmen, müssen Sie die App vor dem Inkrafttreten nicht mehr nutzen und können Ihr Konto löschen.
