ViviTap is a communication assistance application designed for people with communication disabilities and their caregivers ("helpers"). It serves users of all ages, including minors who use the app under parental or guardian supervision. This Privacy Policy explains how we collect, use, store, and protect your personal data in compliance with the EU General Data Protection Regulation (GDPR / DSGVO) and applicable German law.

Regarding health-related data: the use of a communication assistance application may implicitly reveal a communication disability. This constitutes special category data under GDPR Art. 9. We process this data solely to provide the app's core services, based on explicit consent given at registration (Art. 9(2)(a)). This explicit consent is collected through a dedicated consent screen at registration, where users must actively check three separate boxes: (1) acceptance of the Terms of Service and Privacy Policy, (2) acknowledgement that ViviTap may process data relating to their health or disability situation, and (3) confirmation of age eligibility. The consent record, including timestamp and version of the documents presented, is stored securely and associated with the user's account.
We use Firebase Authentication, Firestore, Firebase Storage, Firebase Cloud Messaging, and Firebase Crashlytics. User data (Firestore, Storage) is stored on servers located in europe-west3 (Frankfurt, Germany). Cloud Functions are deployed in europe-west1 (Belgium) and process data transiently without storing it. Crash reports may contain device type, OS version, and anonymized stack traces. If you choose to sign in with Google, your Google account email address and a Google-issued identifier are used solely for authentication purposes. More information: policies.google.com/privacy
We use LiveKit for real-time audio and video calls. Audio and video streams are not recorded or stored by ViviTap. LiveKit may process connection metadata (IP address, connection timestamps) for the duration of the call. LiveKit applies Standard Contractual Clauses (SCCs) for EU data transfers. We use RevenueCat to manage in-app subscriptions. RevenueCat processes your subscription status, purchase history, and an anonymized user identifier. Payments are handled by Google Play. RevenueCat applies SCCs for EU data transfers. More information: revenuecat.com/privacy
You have the right to: access (Art. 15), rectification (Art. 16), erasure (Art. 17) via Settings → Security → Delete Account, restriction of processing (Art. 18), data portability (Art. 20), object to processing (Art. 21), and to withdraw consent at any time.

Some third-party services (LiveKit, RevenueCat) may transfer data outside the EU. All such transfers are covered by Standard Contractual Clauses (SCCs) approved by the European Commission.
ViviTap is not a children's app, but it may be used by individuals under 16 years of age — including people with communication disabilities — under the supervision and with the explicit consent of a parent or legal guardian. In such cases, the parent or guardian creates and manages the account and is responsible for ensuring appropriate use.
By creating an account, you confirm that you are at least 16 years old, or that a parent or guardian has reviewed and accepted these terms and provided explicit consent on behalf of the minor.
All data transmitted between the app and our servers is encrypted in transit using TLS/HTTPS. Firebase infrastructure provides encryption at rest. Access to user data is restricted to authenticated users via Firebase security rules and Cloud Functions.
We may update this Privacy Policy from time to time. We will notify you of significant changes within the app. The date at the top of this page indicates when the policy was last revised.

Concernant les données de santé : l'utilisation d'une application d'aide à la communication peut implicitement révéler un handicap de communication. Ces données relèvent de l'Art. 9 RGPD (données de catégorie spéciale). Nous les traitons uniquement pour fournir les services de base, sur la base d'un consentement explicite donné à l'inscription (Art. 9(2)(a)). Ce consentement est recueilli via un écran dédié avec trois cases à cocher : (1) acceptation des CGU et de la présente politique, (2) reconnaissance du traitement des données liées au handicap, (3) confirmation de l'âge. L'enregistrement du consentement (horodatage, version des documents) est conservé de manière sécurisée.

Wir verarbeiten sie ausschließlich zur Erbringung der Kerndienste, auf Basis einer ausdrücklichen Einwilligung bei der Registrierung (Art. 9(2)(a)). Diese wird über einen dedizierten Einwilligungsbildschirm eingeholt, auf dem drei Kästchen aktiv angekreuzt werden müssen: (1) Akzeptanz der AGB und dieser Richtlinie, (2) Bestätigung der Verarbeitung behinderungsbezogener Daten, (3) Altersbestätigung. Der Einwilligungsnachweis wird sicher gespeichert.

In diesem Fall erstellt und verwaltet der Elternteil oder Vormund das Konto.
Mit der Kontoerstellung bestätigen Sie, mindestens 16 Jahre alt zu sein, oder dass ein Elternteil oder Vormund diese Bedingungen akzeptiert und ausdrücklich zugestimmt hat.
Alle Daten werden per TLS/HTTPS verschlüsselt übertragen. Firebase stellt Verschlüsselung im Ruhezustand bereit. Der Datenzugang ist durch Firebase-Sicherheitsregeln und Cloud Functions auf authentifizierte Nutzer beschränkt.
Wir können diese Datenschutzrichtlinie aktualisieren. Wesentliche Änderungen werden in der App mitgeteilt. Das Datum oben auf dieser Seite zeigt die letzte Überarbeitung.
